Terms of Service

Terms governing access to the Agency Command HQ public website, authorized CRM accounts, and related services.

1. Agreement to these terms

These Terms of Service govern your use of Agency Command HQ. By accessing or using the service, you agree to these Terms and the Privacy Policy. If you use Agency Command HQ on behalf of an agency or organization, you represent that you are authorized to do so.

2. Business-purpose service

Agency Command HQ is a private CRM and agency operations platform intended for authorized insurance professionals and agency personnel. The public website provides information about the software. Agency Command HQ is not an insurance carrier, does not itself issue or underwrite insurance, and this public website is not a consumer insurance marketplace.

3. Accounts and authorized access

  • You must provide accurate information when requesting or maintaining access.
  • You are responsible for safeguarding your account, authentication methods, and devices.
  • You may not share credentials or bypass role, agency, or security restrictions.
  • Access may be suspended, limited, or terminated when an account is unauthorized, inactive, compromised, misused, or no longer associated with an approved agency.

4. Agency and user responsibilities

Authorized agencies and users are responsible for the lawfulness, accuracy, and appropriate use of information they enter, import, connect, send, or process through Agency Command HQ. Users remain responsible for their own licensing, carrier obligations, communications compliance, recordkeeping, and professional decisions.

5. Acceptable use

You may not use Agency Command HQ to:

  • access another agency's information without authorization;
  • attempt to defeat authentication, Row Level Security, permissions, rate limits, or other safeguards;
  • send unlawful, deceptive, harassing, unsolicited, or unwanted communications;
  • upload malicious software or interfere with service operation;
  • misrepresent your identity, agency, licensing, consent, or authority;
  • use the service in a manner that violates applicable law, carrier requirements, telecommunications rules, or third-party rights.

6. Messaging and communications

SMS and other communications sent through or by Agency Command HQ are subject to applicable consent requirements and the SMS Terms. Messaging consent is separate from general acceptance of these Terms and, where applicable, must be freely given, informed, and capable of being withdrawn.

If you receive recurring SMS messages from an Agency Command HQ messaging program, message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help.

7. Customer and agency content

As between Agency Command HQ and an authorized agency, the agency retains its rights in business data and content it lawfully provides to the service. The agency grants Agency Command HQ the rights reasonably necessary to host, process, transmit, secure, back up, and otherwise operate that content as required to provide the service.

8. Third-party services and integrations

Agency Command HQ may connect to third-party services such as authentication providers, communications providers, accounting services, lead vendors, carrier systems, storage providers, or AI services. Third-party services are governed by their own terms and availability. Agency Command HQ is not responsible for a third party's independent service, outage, data practice, or change.

9. Intellectual property

Agency Command HQ, including its software, branding, design, documentation, and service materials, is protected by applicable intellectual-property laws. These Terms grant a limited right to use the service as authorized; they do not transfer ownership of Agency Command HQ intellectual property.

10. Service availability and changes

We may modify, improve, suspend, or discontinue portions of the service as reasonably necessary. We aim to preserve business records and operational continuity, but no online service is guaranteed to be uninterrupted or error-free.

11. No professional advice

Agency Command HQ is an operational software tool. Information, workflows, prompts, calculations, or AI-assisted outputs within the service are not legal, tax, accounting, medical, or insurance advice from Agency Command HQ. Authorized users remain responsible for verifying professional decisions and carrier requirements.

12. Disclaimers and limitation

To the maximum extent permitted by law, the service is provided on an “as available” basis without warranties not expressly stated in a separate written agreement. Liability limitations, warranty terms, indemnification obligations, and service commitments may also be governed by a separate agency subscription or enterprise agreement where applicable.

13. Suspension and termination

We may suspend or terminate access for material violation of these Terms, security risk, nonpayment where applicable, loss of authorization, unlawful use, or conduct that threatens the service or other users. Provisions that by their nature should survive termination will continue to apply.

14. Governing law and disputes

The final production version should identify the legal entity operating Agency Command HQ and the governing jurisdiction applicable to that entity and its customer agreements. Any separate written agreement with an agency may control where it conflicts with these public Terms.

15. Changes

We may update these Terms from time to time. The effective date above identifies the current public version.
